End-user licence agreement (EULA) of the Yoonu Jàngale app

This text applies to the Yoonu Jàngale app, intended for Guides and Teachers (Oustaz and Imams) and downloaded from the yoonujamm.app website. The Yoonu Jamm app, for worshippers' daily practice, has its own texts (yoonujamm.app/terms).

In short

1. Parties and purpose

This end-user licence agreement (the "agreement") is made between Nicolas Geslain, a private individual who publishes the app in a non-professional capacity (the "publisher"), and any person who installs or uses the Yoonu Jàngale mobile app (the "user" or "you").

It sets the conditions under which the publisher grants you the right to use the app. The directory of Oustaz and Imams and its messaging are also governed by the terms of use (yoonujamm.app/jangale/terms), and your data by the privacy policy (yoonujamm.app/jangale/privacy). For the directory, the terms of use specify this agreement; for the licence of the software, this agreement prevails.

2. Acceptance

On first launch, the app shows you this agreement and the terms of use, and asks you to accept them. The accepted version, with the date and time of acceptance, is kept on your phone. If you do not accept, do not use the app and uninstall it.

Each version of this agreement carries a number. When its substance changes, the app asks you to accept the new version at the next launch.

3. Licence granted

The publisher grants you a personal, no-cost, non-exclusive, non-transferable and revocable licence to install and use the app for private and non-commercial purposes, on devices you own or control. The app is downloaded from the yoonujamm.app website; if you get it through an app store, the usage rules of that store also apply (section 15).

The licence is granted, not sold. All rights not expressly granted to you remain with the publisher.

4. What you agree not to do

Except to the extent the law allows it despite this prohibition, you agree not to:

5. Intellectual property

The code, name, logo, texts and design specific to Yoonu Jàngale belong to the publisher and are protected by copyright and trademark law. The text of the Qur'an, its translations and recitations, OpenStreetMap data and fonts remain the property of their authors and are used under their licences, listed in the legal notice (yoonujamm.app/legal-notice).

Content published by Oustaz and Imams in their profile remains theirs; they grant the use needed by the directory under the publication charter.

6. Religious content and worship tools

Prayer times are calculated on the phone using a recognised method, and the Qibla direction depends on the phone's sensors: they are indications, to be checked with your mosque if in doubt. Translations of the Qur'an are those of their authors. The publisher gives no religious opinion and takes no side for any school or brotherhood.

7. Your declarations, under your sole responsibility

The app sometimes asks you to declare information it cannot check: your age (16 or older to use the directory, 18 or older to be listed in it), being the parent or legal guardian of a child, your identity, your profile (Worshipper, Oustaz or Imam) or, for an Oustaz or an Imam, the information on their profile (name, number, languages, specialities, mosque, position).

8. A directory, not a guarantor

Yoonu Jàngale puts people in touch. For the directory, the publisher acts as a technical intermediary: it hosts and displays profiles written by the Oustaz and Imams themselves, and carries messages it does not read, unless they are reported or held back by the automatic filter described in the terms of use.

9. Checking of teachers, with no guaranteed result

The team checks Oustaz and Imams before making their profile visible: identity and adulthood confirmed and, depending on the case, identity document, photo and recommendation from a mosque or an Oustaz already listed. It undertakes to carry out these checks with care (an obligation of means), but cannot guarantee their result: a forged document, false information or a change in behaviour may escape it. A visible profile is neither a recommendation, nor a certificate of good character, nor an endorsement by the publisher.

10. Reporting, suspension and removal

You can report a profile or a conversation from the app; the team reviews each report promptly. The publisher may, without notice when the safety of people requires it, issue a warning, remove content, or suspend or delete an account or a profile, in case of breach of this agreement, the terms of use or the charter, of a false declaration or of a risk to others. It may keep the necessary evidence and pass it to the competent authorities when the law requires. A disputed decision is reviewed on request at [email protected].

11. Parental code

The parental code locks search, messages and My account on the phone where it is set. It is kept only on that phone, as a hash: the publisher can neither read it nor give it back. If it is forgotten, the lock is removed 72 hours after a request made in the app.

The parent or guardian who sets it remains responsible for keeping the code secret and for supervising the child's use of the phone. The parental code is an aid: it does not guarantee that a child will never reach the directory, in particular if the child knows the code, clears the app's data or uses another device. For fuller protection, also use the phone's parental controls (Screen Time on iPhone, Family Link on Android).

12. Availability and changes

The app is provided at no cost, as is. The publisher strives to keep it working properly, but does not guarantee that it will be free of errors, compatible with every device, or available without interruption. The directory depends on an online service that may be interrupted, changed or closed. The publisher may change the app, add or remove features, or stop publishing it.

13. Limitation of liability

To the fullest extent allowed by the applicable law, in particular the Senegalese Code of Civil and Commercial Obligations:

These limits do not apply in case of gross or intentional fault by the publisher, nor to bodily injury, nor to the rights that the law of your country of residence grants you and that no contract may override.

14. Personal data

The publisher processes your data as described in the privacy policy, in compliance with Senegalese Law no. 2008-12 of 25 January 2008 on the protection of personal data and, for the people subject to it, the European General Data Protection Regulation (GDPR). The worship features work without an account; the parental code and the acceptance of this agreement stay on your phone.

15. App stores

Yoonu Jàngale is currently downloaded from the yoonujamm.app website, outside any app store. Should it one day be offered on Apple's App Store or on Google Play, the following rules apply to the version installed from that store. This agreement is made between you and the publisher only, and not with Apple or Google.

16. Term and termination

This agreement applies as long as you use the app. You may end it at any time by uninstalling the app and, for the directory, by deleting your account in My account. The publisher may end it in case of a serious breach on your part, under the conditions of section 10; you must then stop using the app. Sections 5, 7, 13 and 17 continue to apply after the agreement ends.

17. Governing law and jurisdiction

This agreement is governed by Senegalese law. Before any action, write to [email protected]: the publisher will seek an amicable solution with you within 30 days. Failing that, any dispute falls within the jurisdiction of the competent courts of Dakar (Senegal). If you act as a consumer and live in another country, you keep the protection of the mandatory provisions of that country's law, and may bring the matter before the courts it designates.

18. Miscellaneous and contact

If a term of this agreement is held invalid, the others remain applicable. Not enforcing a term does not mean waiving it. For any question or complaint: Nicolas Geslain, publisher of Yoonu Jàngale, [email protected].
